First, I'm so glad that you all are safe.
Second, as somebody that was nearly killed by a reckless driver, please note the following: The OWNER of the insured vehicle IS responsible for ALL of your damages. It doesn't matter if her daughter wasn't covered. Her policy, her problem. Be sure to have YOUR OWN body shop thoroughly inspect your vehicle. You can use one that the other insurance company recommends, but it IS your choice. You must request funds to replace Brody's car seat -- no ifs ands or buts about it. You must request compensation for your discomfort, if you have to miss any time away from work / family / home, etc. It's imperative that you stress to the other insurance company that your baby was in the back seat. They will probably cut you a check just to hush you. Take it! If you do have any neck pain or back pain (it can be delayed onset), immediately contact the insurance adjuster (medical team) and have them pay for your doctor's visit, and again, compensate you for any time missed. They WILL. -- so sorry that you had to be a part of that nonsense! |

not only do they HAVE to replace the car seat, their inspection can't tell if there is internal damage to the thing. We got in a car seat and got Cayten a new $200 car seat that will carry him till he is 8 in our state.
Also, I would go to the chiro and make them pay for it. So worth it. You don't know how much damage is done until they have settled and it is too late to go. |

First, I am so glad that you are all okay.
![]() Second, on top of everything Val said, keep a record of all you mileage as well. You can claim any mileage traveled for Doctors, insurance meetings, lawyers, body shops etc. Anything that is a direct result of the accident. In VA the mileage rate os .445 cents a mile. I realize that isnt much but with the price of gas it always helps. you can check with your lawyer to find out what the going rate is. I would deifintely get a full check up on each of you and add that into the bill. The fact that they were both so rude and uncaring in the situation, i think i would probably have ended up in hail by the time i was done with them. Way to hold your cool! now dtick it to them where it counts. |
