Sorry, i have not had a lot of time to post this until now....
![]() Friday Megan had a half day at school and Sean was off. So he picked her up and they went to the bowling alley. When they were done Megan put the bowling balls back on the storage rack and the rack broke, dropping three 12lb balls on her foot. (brand new equipment by the way) The ER didnt due xrays because they said with a broken foot and/or toes there was nothing they could do except put a boot on her which they did. The Dr. was pretty sure she had several broken toes and a possible fracture to the foot.She is out of spring field hockey and cheer camp for the rest of the school year. The bowling alley put in writing that it was there faulty equipment that caused the accident and Sean is going to the lawyers office today with the medical records and the accident report from the bowling alley. i am not a sue happy person but does anyone agree with me that she is owed something? Shes 12 and has now lost sports for the season. The bowling alley did not offer to comp their games or anything. What should i do???? ![]() |

Sorry she was hurt.I would work on mediation, vs running to court, and try to at least get all her medical expenses and any physical therapy covered. I do find it odd that they didn't do an x-ray to see what the damage was so they would have a reference should she have future problems. If she is in to sports, you might want to talk to a specialist about this to see if there is anything you can do to minimize long term damage/problems. Emergency Room is not the best spot to get these questions delt with. Then the question is did the alley assemble the rack or did they have someone else assemble it? It's rather sad that they didn't even comp them for the game. Heck - I fainted in a video store once (well actually 2 times in a few minutes. ) but they gave us our videos free that night and it wasn't their fault I fainted. ![]() It's amazing what a simple apology can do to make a person feel better and it doesn't cost anything. Though if someone sues you, then that apology is consider accepting that you were in the wrong and at fault. Sad isn't it? |

Well Sean talked to the lawyer yesterday and he feels the same way we do. Get Megan back to 100% and then worry about the bowling alley and getting the bills covered. My number one priority is her and making sure there is no long term damage especially with her being into sports. So we have an appointment with VA Sports Orthopedics next wednesday.
She is so angry right now with finding out she cant start spring league this weekend. I feel so bad for her. |
